These Terms of Service (“Terms”) govern your use of Spirit Level Pro (“the app”), a progressive web app available at spiritlevel.pro. By using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Description of Service

Spirit Level Pro is a browser-based spirit level tool that uses your device’s motion sensors to measure pitch and roll. The app includes free features (bubble level, proximity audio, tolerance presets) and optional paid Pro features (journal, photo proof, PDF reports, CSV export, GPS tagging, hold, slope units, target angle, batch save).

2. Accuracy Disclaimer

Spirit Level Pro is a software tool that relies on your device’s built-in sensors. It is not a certified measuring instrument.

Accuracy depends on your device’s accelerometer and gyroscope hardware, which varies by manufacturer and model.
Environmental factors (vibration, magnetic interference, device case) may affect readings.
The app should not be used as the sole tool for safety-critical measurements including but not limited to: structural engineering, load-bearing construction, gas line installation, medical device alignment, or any application where inaccurate levelling could cause injury, death, or property damage.
Always verify critical measurements with a certified physical spirit level or laser level.

We provide the app on an “as is” and “as available” basis and make no warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose.

3. Pro Features & Payment

Pro is a one-time purchase of $10 USD (or local equivalent) processed by Stripe.
Your Pro status is stored locally on your device. Clearing browser data will remove it. We cannot verify or restore purchases — keep your Stripe receipt email.
We do not currently offer subscriptions or recurring charges.

4. Refund Policy

Because Pro is a digital product delivered instantly, refunds are handled on a case-by-case basis. If you experience a genuine issue, contact us at [email protected] within 14 days of purchase. EU consumers retain their statutory rights under the Consumer Rights Directive. Australian consumers retain their rights under the Australian Consumer Law.

5. Your Data

All measurement data, photos, and settings are stored on your device only. We have no server-side database and cannot access your data. For analytics and payment data handling, see our Privacy Policy.

6. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or extract the source code of the app (beyond what is visible in browser developer tools)
Use the app for any unlawful purpose
Redistribute the app or present it as your own product
Attempt to interfere with the app’s functionality or infrastructure

7. Intellectual Property

Spirit Level Pro, including its code, design, icons, and name, is protected by copyright and intellectual property laws. All rights not expressly granted in these Terms are reserved.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.
We shall not be liable for any damages arising from inaccurate measurements, including but not limited to property damage, construction defects, or personal injury.
Our total liability for any claim shall not exceed the amount you paid for Pro features ($10 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

9. Indemnification

You agree to indemnify and hold harmless Spirit Level Pro and its operators from any claims, damages, or expenses arising from your use of the app or violation of these Terms.

10. Termination

You may stop using the app at any time. We may discontinue the app or restrict access at any time without notice. Your Pro purchase is non-transferable.

11. Governing Law

These Terms are governed by the laws of the European Union for EU/EEA users, and the laws of the jurisdiction where the operator resides for all other users, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of the applicable jurisdiction.

Nothing in these Terms affects your statutory rights as a consumer under the laws of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top will change. Continued use of the app after changes constitutes acceptance.
